Banco barristers appear in major class action - Hip implants

Members of Banco Chambers have appeared in a major class action in the Federal Court of Australia. It is alleged that DePuy and Johnson & Johnson manufactured hip implants that were not reasonably fit for purpose and defective in contravention of the Trade Practices Act. Those hip implants had been recalled before the start of the litigation. Nick Bender is part of the applicants' counsel, and Robert Dick SC and Darrell Barnett are part of the respondents' counsel. This is the first class action in Australia concerning hip implants within the metal-on-metal class of device, and has received considerable media attention.
