Lucas is widely acknowledged in jurisdictions around the world as a leading counsel in all such forms of international disputes, with wide experience in commercial litigation, commercial and investor-state arbitrations, enforcement and immunity proceedings, and multi-jurisdictional commercial disputes. He has appeared in general commercial matters in Australian Courts, and handled several arbitrations with an Australian connection. His experience covers a wide array of sectors, including oil and gas, mining, power, telecommunications, engineering/procurement/construction, entertainment and leisure, information technology, financial services, real estate, aircraft, airline and airport services, media, manufacturing, advertising, taxation, and others. This depth and diversity of experience has placed him at the heart of some of the most complex international dispute issues and cases of the past decade, including appearing or advising on such matters up to the apex court of several jurisdictions, on issues such as waiver of State immunity by arbitration clauses, the operation of hybrid arbitration clauses, scope of orders in assistance of arbitration, scope of remission to arbitral tribunals, the appropriate scope of security for costs, the role of referees, and the proper basis of appeals on such matters.
Lucas is vastly experienced in international commercial arbitration, having acted under all the major arbitral rules and in all the major seats. He is a member of the ICC Australia Steering Committee, the ICISD Panel of Arbitrators and Conciliators, DIAC Arbitrator List, Panel of Arbitrators at SIAC, a Fellow of the ACICA, and a Member of the Court of Arbitration of SIAC. He is experienced not only in leading large commercial arbitration (and court proceedings connected thereto), but also coordinating a strategy involving commercial arbitration but also involving other disputes in other fora. A list of his cases, showing the sectors in which they occurred and the nature of the dispute, is available in his CV.
Lucas is also vastly experienced in international investment arbitration. In addition to sitting as arbitrator and being a member of the ICISD Panel of Arbitrators and Conciliators, he is among the most experienced barristers acting as counsel in the world in this field, including in both the arbitration and in related proceedings in domestic courts relating thereto. Again, a list of his cases, showing the sectors in which they occurred and the nature of the dispute, is available in his CV.
Lucas has also acted for and advised governments, international organisations (including not-for-profit), corporations and individuals across a variety of fora on a wide variety of public international law issues. He has been instructed in disputes before the Dispute Settlement Body of the World Trade Organization, the International Court of Justice, the European Court of Human Rights, and the INTERPOL Commission, covering issues such as investment protection, State responsibility, State and head of State immunity, treaty interpretation, enforcement of decisions, extradition, WTO law, human rights law, INTERPOL de-listing applications, and EU, UK and UN sanctions.
