Declan Roche SC

Declan is a recognised leader in competition and consumer law and is ranked by Doyle’s Guide as a Preeminent Competition Law Senior Counsel. He regularly advises and appears for private clients and the ACCC, and has been involved in many of the leading cases in these fields. He acts for a range of companies including Meta, Anthropic, Uber, Port of Newcastle and Ventia.

Declan also has wide experience in other areas, including family law, commercial law, class actions, defamation, judicial review and regulatory proceedings.

Recent cases include Fewstone Pty Ltd v Australian Competition and Consumer Commission [2026] FCAFC 104 (consumer law, appeal); Franc & Franc [2026] FedCFamC1A 159 (family law, appeal, property); Australian Communications and Media Authority v Jones (No 7) [2026] FCA 860 (pecuniary penalties under the Interactive Gambling Act 2001); and Stillwater Pastoral Company Pty Ltd v Stanwell Corporation Ltd [2024] FCA 1382 (class action, alleged misuse of market power under the Competition and Consumer Act 2010).

Declan was called to the NSW Bar in 2009 and appointed Senior Counsel in 2023. Before coming to the bar, he was a litigation associate at Milbank Tweed Hadley & McCloy in New York and a senior lawyer at the Australian Government Solicitor. Before that, he was a lecturer in law at the London School of Economics. He holds a PhD in law from the Australian National University. He is the author of Accountability in Restorative Justice (Oxford University Press), which won the British Society of Criminology Book Prize.
